Your Right of Redemption After a Georgia Tax Sale

Your house sold at a tax sale — in Georgia, you may still have 12 months to act.

If your property was sold at a tax sale, it is easy to assume it is gone for good. In Georgia, that is usually not true right away. Georgia is a redeemable tax-deed state, which means the law gives you a window after the sale to reclaim the property — or to act on the value you still hold. This guide explains the right of redemption, what it costs, and how a fast sale can fit before the window closes.

The 12-Month Right of Redemption

Under O.C.G.A. 48-4-40, the owner — along with creditors and others with an interest in the property — has the right to redeem the property for 12 months after the tax sale. During that period the tax-sale purchaser holds a tax deed but generally cannot take possession, collect rent, or improve the property. Redeeming puts title back where it was before the sale, subject to the liens that existed at the time. The right stays open until it is properly foreclosed, even past the 12-month mark, but the safe assumption is to act within the year.

What Redemption Costs

Under O.C.G.A. 48-4-42, the redemption price is the amount the purchaser paid at the tax sale, plus any taxes and special assessments they paid afterward, plus a premium — 20% of that amount for the first year or fraction of a year, and 10% for each year or fraction of a year after that, along with certain costs. In short, the price climbs the longer you wait, which is another reason acting early matters. After 12 months, the purchaser may move to foreclose and forever bar the right of redemption under O.C.G.A. 48-4-45 by serving notice and publishing it once a week for four weeks.
